The High Court of Cassation and Justice resolved a pre-ruling referral from the Cluj Court of Appeal, establishing a mandatory interpretation for labor and social security litigation: a pensioner who qualifies for a reduced mandatory contribution period under Article 58 of Law no. 263/2010 (formerly Art. 47 of Law no. 19/2000) due to a pre-existing disability is not entitled to the additional bonus points provided by Article 169(1) of the same legislation. The dispute concerned the compatibility of two distinct legislative benefits within the unified public pension system, specifically whether a pensioner could claim extra points for performing work under disability conditions when they already benefited from a shortened minimum contribution period. The court determined that these benefits are mutually exclusive, prohibiting the accumulation of the additional points in cases where the reduced contribution period rule is applied.
