The Supreme Court of Romania (High Court of Cassation and Justice) dismissed as inadmissible the preliminary reference submitted by the Sibiu County Court, meaning no binding interpretation of the legal issue was issued and the lower court's proceedings remain unaffected by this decision. The dispute concerned whether the conditions for extinguishing a credit claim through a repayment-in-kind arrangement (dare în plată) under the Law no. 77/2016, specifically the requirement that the guarantee be a residential property regardless of the loan's purpose, applies when the main debtor is a professional rather than a consumer. The key legal issue involved the scope of application of Law no. 77/2016, particularly Art. 4(1)(c) and its relationship with Art. 1(1) and (3), which generally limit the law to legal relationships between consumers and credit institutions or non-banking financial institutions, and whether these consumer-protection provisions extend to professionals who are guarantors or co-debtors.
