The High Court of Cassation and Justice, in its capacity to resolve questions of law, admitted a referral from the Bucharest Court of Appeal and issued a binding interpretation establishing that the equalization of allowances to the maximum level under Article 1(51) of Emergency Government Ordinance No. 83/2014 (as amended) encompasses increases and revaluations recognized by judicial decisions for magistrates or auxiliary personnel, regardless of whether the credit orderer issued corresponding payroll orders. This uniform interpretation was requested to clarify the application of public sector salary regulations to judicial and auxiliary staff, specifically addressing whether statutory equalization provisions apply to court-awarded salary adjustments even in the absence of administrative execution. The decisive legal basis is the interpretation of Article 1(51) of Emergency Government Ordinance No. 83/2014, approved with modifications by Law No. 71/2015, which mandates that the equalization mechanism covers all judicially recognized entitlements to salary increases or indexations.
