The High Court of Cassation and Justice declined its jurisdiction and transferred the motion to change venue (strămutare) to the Court of Appeal Alba Iulia, which prevails on the procedural question; the requesting party's motion to transfer Case No. x/175/2017 pending before the Alba Tribunal, civil section, based on legitimate suspicion, remains to be decided by that appellate court. The dispute concerned a request under Article 142(1) of the Romanian Code of Civil Procedure, which assigns jurisdiction over such motions based on legitimate suspicion to the court of appeal when the court from which transfer is sought is a tribunal within its circuit. Applying Article 131 and Article 142(1) C. proc. civ., the High Court ruled it lacked material competence because the tribunal falls under the Alba Iulia Court of Appeal's jurisdiction, ordering the declination without appeal.

Potrivit dispozițiilor art. 142 alin. (1) C. proc. civ., cererea de strămutare întemeiată pe motive de bănuială legitimă este de competența curții de apel, dacă instanța de la care se cere strămutarea este o judecătorie sau un tribunal din circumscripția acesteia.
