The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling submitted by the Bucharest Court of Appeal, leaving the lower court to resolve the case without a binding interpretation from the supreme judicial body. The dispute concerned a labor and social insurance matter, specifically whether the procedural effects mandated by Article 518 of the Code of Civil Procedure caused the application of a previous Decision in the Interest of Law regarding pension law to cease after the enactment of Law No. 263/2010 on the unified public pension system, which abrogated the originally interpreted legal texts while retaining their substance in the new legislation. The decisive legal basis for the dismissal was the procedural framework governing admissibility of referrals to the High Court’s Complete Bench for legal issues under Articles 518 and 521(3) of the Code of Civil Procedure.
