Prisoner's appeal for suspension of sentence execution dismissed as unfounded due to absence of special circumstances
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the prisoner's appeal as unfounded, thereby upholding the lower courts' decisions to deny his request for a suspension of sentence execution. The dispute concerned a criminal procedure where an individual sentenced to three years of imprisonment sought a temporary interruption of his penalty to address family issues. The court ruled that the statutory requirements for such an interruption were not met, finding no "special circumstances" under the relevant procedural codes that would make the execution of the sentence have grave consequences for the offender or his family, as the social investigation confirmed the family had adequate housing and livestock resources. Consequently, the final operative outcome is the rejection of the appeal and the imposition of judicial costs on the appellant.

Potrivit art.
