The High Court of Cassation and Justice admitted the referral from the Cluj Court of Appeal and established a mandatory legal interpretation, ruling that a tax debt definitively deemed unable to be enforced in insolvency proceedings due to late filing cannot subsequently be used by the tax authority to offset or reduce the tax refund owed to the insolvent debtor. This decision resolves a conflict regarding the interaction between insolvency law and tax procedure, specifically addressing whether the non-recovery of a tax claim in bankruptcy due to untimeliness bars the creditor from utilizing that same debt in a Value Added Tax (VAT) refund procedure initiated by the debtor. The court grounded its ruling in Article 1473 of Law No. 571/2003 (Fiscal Code), interpreted in light of the insolvency framework established by Law No. 85/2006, thereby prioritizing the finality of the insolvency determination over subsequent administrative tax recovery attempts.
