The High Court of Cassation and Justice, acting as the full panel for resolving legal questions, admitted the referral from the Bucharest Court of Appeal and definitively established that no additional conditions are imposed for granting the monthly reparative allowance to the children of heroes-martyrs after the age of 26. The dispute centered on a conflict of labor and social security law regarding the eligibility of a beneficiary for this specific social benefit under the Law on Gratitude towards Heroes-Martyrs and Fighters of the 1989 Romanian Revolution. The decisive legal basis was the interpretation of Article 4(2)(c), last thesis, of Law No. 341/2004, as amended by Emergency Government Ordinance No. 95/2014, where the court clarified that the statutory provisions do not restrict the entitlement to the allowance based on the beneficiary's age once they exceed 26 years.
