The High Court of Cassation and Justice dismissed as inadmissible the request by the Bucharest Court of Appeal for a preliminary ruling on a question of law, leaving the lower court's procedures unaffected. The dispute centered on the interpretation of the retirement date under the Judges' and Prosecutors' Status Law, specifically whether it referred to the date of release from office due to retirement or the date pension rights were established by an administrative decision. The court's decisive legal basis for dismissal was Article 521(3) of the Civil Procedure Code, which governs the admissibility and binding nature of submissions to the Complete Court for Clarification of Legal Issues.
