The High Court of Cassation and Justice admitted the referral from the Bucharest Court of Appeal and, in a preliminary ruling for the uniform interpretation of law, established that, under Article 179(4) of Law No. 263/2010 on the unitary public pension system, a pension house may directly recover sums paid as social insurance benefits pursuant to a court judgment that was later quashed on appeal, by issuing a debt decision that constitutes an enforceable title. The dispute arose in a labor and social insurance case where the pension house sought recovery of benefits after the underlying judgment was overturned; the Court thus held that no separate court action is required for such recovery. The ruling is binding pursuant to Article 521(3) of the Civil Procedure Code and was pronounced in a public hearing on 5 March 2018.
