Legislator summary

AI generated

The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal of Constanța, effectively leaving the lower courts without a binding principle on the specific legal question raised and leaving the status quo regarding the interpretation of the relevant criminal code provisions in place. The dispute concerned whether driving a motor vehicle or tram on public roads without a driving license remained punishable under Article 335(1) of the Penal Code following the Constitutional Court’s Decision No. 224 of April 4, 2017, and its publication in the Official Gazette on June 9, 2017. The decisive legal basis for the dismissal was procedural inadmissibility, determined by the Complete for the Resolution of Legal Issues in Criminal Matters, which found the session request did not meet the statutory requirements for a preliminary ruling under the Code of Criminal Procedure.
