The High Court of Cassation and Justice ruled that the Bucharest Court of Appeal has jurisdiction to hear a motion for transfer of a civil case currently pending before the Piatra Neamț Court of Appeal, effectively assigning the competence to the higher appellate body. The dispute concerned a procedural request to transfer a case based on legitimate suspicion (recusal grounds), initiated after the entry into force of Law no. 134/2010 regarding the New Code of Civil Procedure. The court’s decision was grounded in Article 142(1) of the Code of Civil Procedure, which stipulates that motions for transfer founded on legitimate suspicion are within the exclusive jurisdiction of the Court of Appeal when the requesting instance is a court of appeal.
