The Supreme Court of Cassation and Justice dismissed the reference for a preliminary ruling as inadmissible, leaving the lower courts to proceed without its intervention on the substantive questions raised. The dispute originated from a request by the Cluj Court of Appeal, Section of Administrative and Fiscal Contentious, to clarify the legal nature of a pre-operational urbanism certificate—whether it constitutes an individual administrative act or a non-producing administrative operation—and whether such a certificate can be judicially reviewed for legality in the absence of an explicit request by an interested party, pursuant to Article 18(2) of Law No. 554/2004 on Administrative Contentious Proceedings. The decision was issued under the mandatory nature of the reference as prescribed by Article 521(3) of the Code of Civil Procedure, thereby rejecting the request for a definitive interpretation on these specific urban planning and administrative procedural issues.
