The High Court of Cassation and Justice dismissed as inadmissible a referral from the Oradea Court of Appeal seeking a preliminary ruling on whether courts can issue a judgment substituting for a restitution order (dispoziție) under Article 21 of Law No. 165/2013 and Article 26 of Law No. 10/2001, concerning properties abusively seized during Romania's communist regime. The court declined to answer the question, leaving the appellate court to resolve the underlying dispute without such guidance, and made the dismissal binding under Article 521(3) of the Civil Procedure Code. The referral was procedurally improper for a preliminary ruling, as the issue raised did not meet the statutory admissibility requirements for this mechanism.
