The High Court of Cassation and Justice, in its Special Composition for Legal Interpretation, ruled that the pensioners of the state military pension system are explicitly excluded from the category of "public pension system pensioners" eligible for the allowance under Article 1(1) of Law No. 8/2006. This decision resolved a preliminary reference (hotărâre prealabilă) initiated by the Pitești Court of Appeal, establishing a binding legal interpretation that the term "public pension system" in the context of the 2006 law does not encompass the military pension regime governed by Law No. 223/2015. By definitively interpreting the scope of the eligibility criteria, the court clarified that military pensioners do not qualify for the specific allowance, thereby determining the substantive rights and obligations in cases involving such claims.
