The Supreme Court of Romania dismissed as inadmissible a request for a preliminary ruling submitted by the Constanța Court of Appeal, leaving the lower court to resolve the dispute without binding guidance on the specific legal interpretation at issue. The proceeding concerned a civil matter under Law No. 77/2016 regarding the surrender of real property to settle credit obligations, specifically challenging the interpretation of the phrase "credit contracts in progress at the time of its entry into force." The decisive legal basis for the dismissal was the procedural requirement for the admissibility of preliminary questions under Article 521(3) of the Code of Civil Procedure, which was not met by the referring court's submission.
