The High Court of Cassation and Justice dismissed as inadmissible the referral submitted by the Covasna Tribunal, thereby leaving the lower court to resolve the underlying civil dispute without a preliminary ruling. The dispute concerned the interpretation and application of the legal presumption of legal capacity (capacitate de folosință) versus the possibility of rebutting it through a judicial presumption, specifically in the context of civil capacity and procedural provisions. The decisive legal basis involved Articles 329 and 328(2) of the Civil Procedure Code, read in conjunction with Articles 103 and 53 of the Civil Code, focusing on the interplay and hierarchy between legal and judicial presumptions.
