The Supreme Court of Romania dismissed as inadmissible the referral for a preliminary ruling on a question of law submitted by a Bucharest Court of Appeal, meaning no substantive legal determination was issued on the merits of the dispute. The case involved a challenge regarding the legal nature and contestability of minutes (procese-verbale) drafted by anti-fraud inspectors under the Emergency Governmental Ordinance No. 74/2013, approved with amendments by Law No. 144/2014, which concerned measures for the reorganization of the National Agency for Fiscal Administration. The decisive legal basis for the dismissal was the procedural requirement for the admissibility of referrals to the specialized panel for resolving questions of law under Article 521 paragraph (3) of the Code of Civil Procedure.
