The High Court of Cassation and Justice dismissed as inadmissible the appeal filed by the convicted appellant against the Court of Appeal’s decision rejecting his motion for nullification, leaving the lower court's dismissal in force and ordering the appellant to pay 700,000 lei in judicial costs to the state. The dispute concerned the appellant’s challenge to the refusal to credit 109 days earned through labor performed during the execution of a six-year prison sentence as time served, where the appellate court had initially rejected the nullification motion on the grounds that the cited reason did not fall within the statutory categories for such remedies. The decisive legal basis was the procedural limitation under the last paragraph of Article 392 of the Code of Criminal Procedure, which restricts appeals to nullification judgments only when based on Article 386(1)(d); because the underlying motion was not founded on that specific provision, the appeal was deemed an unauthorized legal remedy against a final judgment that had entered res judicata, leading to its rejection under Article 38515(1)(a).

Asupra recursului de față;
