Admissibility of conjoined references to the Plenary for resolving civil legal issues
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible three conjoined references to settle a legal issue, thereby resolving the procedural challenge without a substantive ruling on the merits. The dispute involved civil cases originally brought before the Pitești Court of Appeal, where lower courts sought preliminary clarification from the Supreme Court's Plenary on pending legal questions. Relying on Article 521(3) of the Code of Civil Procedure, the Plenary declared the references inadmissible, rendering the decision obligatory and leaving the underlying civil proceedings to be determined by the appellate courts without the requested unified interpretation.
