Prison illness treated in-facility negates statutory impossibility for sentence suspension
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the criminal appeal, definitively upholding the lower court decisions that refused to suspend the execution of the defendant's ten-year imprisonment sentence for attempted murder. The dispute concerned the defendant's request to interrupt his sentence due to illness, which was initially denied by the court of first instance and subsequently affirmed by the appellate court; the Supreme Court found the appeal unfounded. Relying on Articles 453(a) and 455 of the Code of Criminal Procedure, the Court held that suspension of sentence is only permissible if a medico-legal expert confirms the illness renders the prisoner incapable of being deprived of liberty, whereas the evidence in this case established that the defendant's medical condition could be treated within the prison medical network, thus failing to meet the statutory requirement for suspension.

Asupra recursului de față;
38515 pct. 1 lit. b) C. proc. pen., hotărârea atacată va fi menținută prin respingerea recursului, conform dispozitivului deciziei.
