The High Court of Cassation and Justice, through its Full Court for Resolving Legal Issues in Criminal Matters, rejected the referrals as inadmissible, leaving the initial petitions from the Court of Appeal of Bucharest and the Brașov Court of Law without admissible effect for further deliberation. The dispute concerned the interpretation of Article 4 of the Penal Code regarding the constitutional status of Article 246 of the 1969 Penal Code and Article 297(1) of the Penal Code, specifically whether the phrase "performs in a defective manner" was rendered unconstitutional by Constitutional Court Decision No. 405/2016, which limited its scope to violations of the law and thereby decriminalized the act of a public official who fails to perform a duty or violates a normative act lacking the force of law, as established by a final criminal judgment. The referral also questioned whether the legislative amendment decriminalizing certain acts is effective even where the Constitutional Court declared the provisions unconstitutional without a subsequent specific legislative intervention, particularly in relation to Article 132 of Law No. 78/2000 concerning the prevention, discovery, and sanctioning of corruption offenses. The decisive legal basis for the rejection of the referrals as inadmissible is not detailed in the operative decision text, but the matters referred involved the application of Article 4 of the Penal Code, Constitutional Court Decision No. 405/2016, and Article 477(3) of the Code of Criminal Procedure regarding the mandatory effect of the decision from the date of publication in the Official Gazette.
