The High Court of Cassation and Justice of Romania dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal of Bacău, leaving the underlying civil proceedings unaffected. The referred legal issue concerned whether courts could award interest on contractual remuneration interest, interest on statutory penalty interest, or both, as derived from the interpretation of Civil Code Article 1489(2) alongside Government Ordinance No. 13/2011 (Articles 8(3) and 18(3)) regarding legal remuneration and penalty interest for monetary obligations. The decision was grounded in Civil Procedure Code Article 521(3), which governs the competence and admissibility of the Complete Body for resolving issues of law, thereby establishing that the specific interpretation query did not meet the procedural requirements for a binding preliminary ruling.
