Automatic termination of manager's employment contract upon final criminal conviction under Law No. 22/1969
Legislator summary
AI generatedThe High Court of Cassation and Justice rejected as inadmissible a reference for a preliminary ruling submitted by the Court of Appeal of Iași, leaving the lower court to resolve the matter without a binding interpretation from the supreme court. The dispute concerned labor law, specifically whether the individual employment contract of a manager (gestionar) automatically terminated by operation of law upon the final conviction for specific economic offenses, or if this constituted a special statutory ground distinct from the general termination provisions in the Labor Code that would require the issuance of a specific administrative decision. The decisive legal basis involved the interpretation of Article 4 of Law No. 22/1969 regarding the employment of managers and the potential interplay with Article 56 of Law No. 53/2003 (the Labor Code), focusing on whether the 1969 provision created an independent mechanism for automatic termination or if it was inapplicable due to the subsequent codification of labor relations.
