The High Court of Cassation and Justice admitted the preliminary ruling request and held, as binding under Art. 521(3) of the Civil Procedure Code, that under Art. 42(3) of Law No. 10/2001 (on restitution of property abusively taken between 1945–1989), tenants of housing units not only have the preemption right but also retain the right to opt to purchase the property under Art. 9(1) of Law No. 112/1995. The referral arose from a civil case concerning the interplay between restitution and tenant purchase rights, and the court resolved the legal question in favor of the tenants, confirming their cumulative purchase option alongside preemption.
