The Supreme Court of Romania’s Full Bench for Resolving Questions of Law dismissed as inadmissible the reference made by the Brașov County Court regarding the interpretation of the Law No. 193/2000 on consumer credit. The dispute concerned whether a natural person who had voluntarily and fully repaid a consumer credit contract retained the standing and legal interest to challenge specific contractual clauses as abusive and seek restitution of payments made under those clauses. The Court’s decision was grounded exclusively in the procedural requirement of Article 521(3) of the Civil Procedure Code, rendering the reference inadmissible without addressing the substantive questions of consumer protection or the interpretation of the relevant statutory provisions concerning consumer status and the consequences of abusive clauses after contract termination.

DECIDE:

521 alin. (3) din Codul de procedură civilă.
