The Supreme Court of Romania (High Court of Cassation and Justice) dismissed as inadmissible the reference for a preliminary ruling submitted by the Cluj Court of Appeal, leaving the lower court's procedural posture unchanged. The dispute concerned a labor law issue regarding the suspension of the retirement indemnity for judges, instituted by temporary normative acts until 2017, with the referring court seeking clarification on whether this suspension compromised the foreseeability and substantive content of the right to retirement indemnity. The decision is grounded in the interpretation of Article 81(1) of Law No. 303/2004, viewed in conjunction with the principles established by Constitutional Court Decision No. 42/2014 and prior High Court decisions (No. 16/2015 and others), and the procedural requirements under Article 521(3) of the Civil Procedure Code for the admissibility of such references.
