The Supreme Court admitted the referral from the Cluj Tribunal and definitively established that the ruling issued by the enforcement court on a request to compel the payment of penalty interest is final and non-appealable, regardless of whether the request is granted or rejected. This decision resolved a procedural dispute concerning the appellate nature of decisions made by enforcement courts when handling applications to enforce specific performance obligations (to do or not to do, convertible into monetary value) through daily delay penalties. The court grounded its ruling in Articles 906(1) and (2) of the Romanian Code of Civil Procedure, which govern the enforcement of such obligations, and determined that this interpretation is mandatory for all competent courts pursuant to Article 521(3) of the Code.
