The High Court of Cassation and Justice (Administrative and Fiscal Litigation Section) declared the appellant's challenge against the decision of the Judicial Inspectorate of the Superior Council of Magistracy to be perimed (lapsed) and irreversibly dismissed it. The case was initially suspended on 20 November 2013 due to the parties' unjustified absence, and after remaining inactive for one year, the court raised the exception of peremption. The sole legal basis was procedural: under Article 248(1) of the Civil Procedure Code, any claim or challenge lapses as of law if left unaddressed for a year due to the party's fault, and since no procedural acts interrupted or suspended the peremption period under Articles 249–251, the court applied Article 252(1) and found the challenge perimed.

Decizia nr. 150/2015

252 alin. (1) C. proc. civ. și va constata perimată contestația.
