Peremption of appeal due to one-year inactivity despite pending dispute over civil judgment enforcement formula
Legislator summary
AI generatedThe High Court of Cassation and Justice upheld the underlying appellate decision by declaring the appellant's appeal perished (extinguished), leaving the Court of Appeal's earlier rejection of the enforcement writ request in force. The dispute arose from a civil judgment where the appellant sought an enforcement formula, but the appeal remained inactive for a full year without any procedural acts that could interrupt or suspend the statutory deadline. The Court relied on Articles 248(1) and 252(1) of the Code of Civil Procedure, finding that the appeal was perished ex lege due to the one-year period of inactivity attributable to the parties, absent any valid grounds for interruption or suspension under Articles 249–251.

Decizia nr. 144/2015
Asupra cererii de față;
252 alin. (1) C. proc. civ. și va constata perimat recursul.
