The High Court of Cassation and Justice (Romania), ruling on a preliminary question referred by the Bucharest Court of Appeal in a criminal tax evasion case, admitted the referral and established that the acts and omissions listed in art. 9(1) lit. b and c of Law No. 241/2005 on preventing and combating tax evasion, when referring to the same commercial company, constitute alternative modes of committing the offense rather than distinct normative offense types; accordingly, they form a single continuous offense of tax evasion under art. 9(1) lit. b and c of that law. The decision is binding from its publication in the Official Gazette of Romania, Part I, pursuant to art. 477(3) of the Criminal Procedure Code. The dispute concerned the interpretation of the material element of tax evasion, specifically whether multiple statutory acts (e.g., omission of accounting records and altering documents) against the same taxpayer merge into one offense or constitute separate offenses. The court based its ruling on the structure and legislative intent of Law No. 241/2005, holding that the enumerated actions are alternative modalities of the same material element, thereby requiring unitary legal classification and punishment as a single offense.

Romanian high court rules statutory tax-evasion acts against same company are alternative modes, not separate offenses; single continuous offense confirmed and made binding: Stabileşte că acţiunile şi inacţiunile enunţate în art.9 alin.1 lit.b şi c din Legea nr.241/2005 pentru prevenirea şi combaterea evaziunii fiscale, care se referă la aceeaşi societate comercială, reprezintă variante alternative de săvârşire a faptei, constituind o infracţiune unică de evaziune fiscală prev. de art.9 alin.1 lit.b şi c din Legea nr.241/2005 pentru prevenirea şi combaterea evaziunii fiscale.
