The Supreme Court of Romania dismissed as inadmissible the referral submitted by the Court of Appeal for a preliminary ruling on the procedure for completing the operative part of a final appellate judgment that is not subject to cassation. The dispute centered on whether a request to complete the dispositive section of a judgment falling under Article 444(1) of the Code of Civil Procedure is admissible, and if so, the applicable deadline for such a request. The Court determined that the question did not meet the requirements for a binding interpretation under the specific procedural framework for resolving issues of law, thereby leaving the lower court's procedural handling of the case unaffected by the referral.
