The Supreme Court of Judicature and Cassation dismissed as inadmissible the preliminary legal question submitted by the Court of Appeal of Braşov, thereby rejecting the request for a unifying ruling and leaving the procedural path for the lower court to resolve the matter independently. The dispute concerned a claim for political persecution benefits under the 1990 Decree-Law, specifically whether a final judgment confirming a family member's eligibility for such benefits creates a binding presumption that automatically extends eligibility to the applicant without the need for additional corroboration by other evidence. The court addressed the potential interpretation of Article 1 and Article 10 of the Decree-Law in conjunction with Article 14 of the European Convention on Human Rights, regarding the evidentiary weight of existing judicial findings on family members, but determined that the reference was not admissible for the resolution of a question of law under Article 521(3) of the Code of Civil Procedure.

Completul pentru dezlegarea unor chestiuni de drept

Minuta deciziei nr. 63 Dosar nr. 1510/1/2017

Şedinţa de la 25 septembrie 2017

ÎN NUMELE LEGII

DECIDE:
