The High Court of Cassation and Justice ruled that both the imposition of a conviction for a new intentional crime and the revocation of a previously suspended sentence are mandatory, resolving a legal conflict submitted by an appellate court. The dispute concerned whether, when a defendant commits a new intentional offense during the supervision period of a suspended sentence, the lower courts could suspend the new sentence without revoking the earlier one. Citing Article 83(1)(b) and Article 88(3) of the Penal Code, the Court established that the occurrence of a new intentional crime within the supervision period necessitates the automatic revocation of the prior suspension alongside the new conviction, a binding interpretation effective from publication in the Official Gazette.
