Mortgage as Independent Enforceable Title: Execution of Secured Debt Without Underlying Enforceable Instrument
Legislator summary
AI generatedThe High Court of Cassation and Justice issued a binding preliminary ruling, mandated by the Civil Procedure Code, establishing that a monetary claim secured by a valid mortgage contract can be subject to forced execution even if the underlying debt instrument itself does not qualify as an enforceable title under the law. The dispute concerned whether the execution of a claim guaranteed by a mortgage required the underlying credit right to be documented in a separate enforceable title, with the High Court resolving this legal uncertainty initiated by the Bucharest Tribunal. The decisive legal interpretation rests on Article 2431 of the Civil Code in conjunction with Article 632 of the Civil Procedure Code, which confirms that the valid mortgage contract acts as the sufficient enforceable title for execution, irrespective of the formal nature of the underlying debt document.
