The High Court of Cassation and Justice, acting as the full bench for resolving legal issues, admitted the referral from the Bucharest Tribunal and issued a binding decision holding that Article 453(1) of the Code of Civil Procedure remains applicable to claims seeking the mandatory bearing of litigation costs arising from a separate, definitively settled dispute. The legal dispute concerned the procedural framework for enforcing an obligation to support or bear judicial expenses generated by a prior case, challenging the scope of applicability for such costs-awarding provisions. Relying on the mandatory force of decisions issued under Article 521(3) of the Code of Civil Procedure, the court clarified that the referenced procedural norm governs the specific type of civil action involving the enforcement of cost liabilities from other litigations.
