Tax inspection suspension appeal perished after six-month inactivity, upholding dismissal and deposit return
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the appeal perished, thereby upholding the lower court's decision that had dismissed the suspension request and ordered the return of the deposit to the appellant. The dispute involved a company's challenge to the inadmissibility of its request to suspend a tax inspection report issued by the county tax administration, which was rejected by the Court of Appeal on the grounds that no procedural acts were performed to interrupt or suspend the running of the time limit. Applying Articles 416(1) and 420(1) of the Code of Civil Procedure, the Supreme Court found that the case remained in abeyance for six months due to reasons imputable to the party without any intervening procedural steps, resulting in the automatic peremption of the appeal under Article 417-418 of the same Code.

Decizia nr. 2510/2015
420 alin. (1) C. proc. civ. și va constata perimarea cererii.
