Scope of "political police" exclusion in civil service: whether "collaborators with the Security" are encompassed within the statutory disqualification for public office
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the referral by the Bucharest Court of Appeal, leaving the lower instance’s handling of the underlying administrative dispute unchanged. The case involved a request for a preliminary ruling to resolve a conflict regarding the interpretation of the term "political police" under Article 54(l)(j) of Law No. 188/1999 on the Status of Civil Servants, specifically whether this concept encompasses "collaborators with the Security" as defined in Law No. 187/1999 and Emergency Ordinance No. 24/2008, or is limited strictly to "Security agents." The decisive legal basis for the dismissal was Article 521(3) of the Civil Procedure Code, which governs the admissibility requirements for preliminary references submitted to the complete bench for resolving legal questions.
