Peremption of commercial appeal for inactivity exceeding six-month statutory limit
Legislator summary
AI generatedThe High Court of Cassation and Justice confirmed the procedural extinction of the appeal, ruling that the appeal filed by the defendant-company against the appellate court’s commercial decision was perished. The dispute involved a commercial case where the appellate proceedings were previously suspended due to the unexcused absence of the parties, resulting in the appeal remaining in a state of inactivity. The court determined that because the six-month statutory limitation period for commercial matters had expired without any statutory interruption or suspension of the perishment, the appeal was deemed lapsed as a matter of law under Articles 248(1) and (3) of the Civil Procedure Code, thereby leaving the underlying appellate decision as the final, unchallenged outcome.
