Transfer-of-venue request sent to Constanța Court of Appeal as competent forum; High Court declines jurisdiction.
Legislator summary
AI generatedThe High Court of Cassation and Justice (Civil Section I) declined its own jurisdiction and transferred a transfer-of-venue application (strămutare) to the Constanța Court of Appeal, ruling without appeal. The application sought to move a case pending before the Constanța Tribunal, involving an action filed on 23 October 2014, after the entry into force of the new Civil Procedure Code (15 February 2013). Applying Article 142(1) of the new Civil Procedure Code, the Court held that transfer requests based on legitimate suspicion are within the exclusive jurisdiction of the court of appeal in whose circuit the lower court sits; because the Constanța Tribunal falls under the Constanța Court of Appeal per Annex I to Law No. 304/2004, that appellate court—not the High Court—was the competent forum to decide the matter.
