The High Court of Cassation and Justice admitted the referral from the Timişoara Court of Appeal and issued a preliminary ruling that the phrase "salarizat la acelaşi nivel" (remunerated at the same level) in Article 1(5¹) of Emergency Ordinance No. 83/2014, as approved and amended by Law No. 71/2015, also covers personnel within public authorities and institutions listed in Article 2(1)(b) of Framework Law No. 284/2010 on the unitary remuneration of publicly funded personnel. The ruling arose from an administrative and fiscal dispute concerning the interpretation of salary equalization provisions under the 2015 public-sector pay legislation. The Court held that, based on the cited statutory provisions, the contested phrase encompasses all staff of public authorities and institutions under the referenced framework law, making the interpretation binding under Article 521(3) of the Civil Procedure Code. The decision, rendered in a public hearing on July 3, 2017, thereby established a mandatory precedent in favor of extending the salary-level reference to the broader category of public-sector employees.
