The High Court of Cassation and Justice admitted the preliminary reference from the Court of Appeal of Suceava and held that the unemployment allowance may be cumulated with the sitting allowance for local councilors, a decision that is mandatory under civil procedure law. The dispute concerned the interpretation of incompatibility and cumulation rules for public officials, specifically whether local councilors, who are considered to hold public positions, could simultaneously receive both an unemployment benefit and a compensation for attending council sessions. Relying on a strict interpretation of Article 5, item IV, letter (c) and Article 44, letter (n) of Law No. 76/2002, read in conjunction with Articles 34 and 36 of Law No. 393/2004, the court determined that no legal prohibition exists against the concurrent receipt of these two specific types of income.
