The High Court of Cassation and Justice, in its Plenary session for resolving questions of law, upheld the lower court's reference and established that the collection of remuneration by a collective management body for performers' rights regarding the broadcasting or public communication of sound recordings is not a taxable operation under Value Added Tax (VAT). This decision resolves a procedural dispute initiated by the Bucharest Court of Appeal concerning the VAT classification of such income, determining that it falls outside the scope of VAT liability. The ruling is based on the joint interpretation of Article 126(1)(a) and Article 129 of the Fiscal Code (Law no. 571/2003), and Article 98(1)(g1) and Article 1065 of the Copyright Law (Law no. 8/1996), clarifying that these specific collections of royalties do not constitute taxable supplies for VAT purposes.
