The High Court of Cassation and Justice dismissed the referral for the resolution of a legal question as inadmissible, meaning the specific fiscal interpretation requested by the referring Court of Appeal was not established and the dispute remains unresolved at the appellate level. The procedure involved a request to determine whether damages awarded by final judicial decisions for the contravalue of meal vouchers (tichete de masă) constitute wage rights subject to individual mandatory social contributions or retain the tax-exempt status of meal vouchers not distributed in kind. The legal basis for the decision was the procedural admissibility requirements under Article 521(3) of the Code of Civil Procedure, which rendered the referral regarding Articles 55(2)(j1), 2964(1)(k), 29615(o), and 29618(51) of Law No. 571/2003 (Fiscal Code) inadmissible.
