The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal Suceava, leaving the lower court’s procedure pending without resolving the substantive legal issue. The dispute concerned civil procedure, specifically whether the failure to attach proof of payment of judicial stamp fees to an appeal petition renders the appeal null and void or if the deficiency can be cured later pursuant to the procedure established by Emergency Government Order No. 80/2013. The decisive legal basis for the decision was the procedural admissibility requirements for referrals to the Grand Chamber, specifically Article 521 paragraph (3) of the Civil Procedure Code, which governs the conditions for the court to issue a mandatory preliminary ruling to resolve conflicts of law.
