The High Court of Cassation and Justice dismissed the referral as inadmissible, thereby upholding the procedural status quo without providing a preliminary legal ruling. The dispute arose from a criminal case regarding drug trafficking, where the Court of Appeal Timișoara referred a question of law concerning whether the obligation to preserve counter-evidence under Article 17(1) of Law No. 143/2000 extends to technical and scientific procedural methods, and what sanctions may be imposed for non-compliance. The decisive legal basis for the rejection was the procedural admissibility requirements for referrals under Article 477(3) of the Code of Criminal Procedure, which the referring court failed to satisfy, resulting in no substantive interpretation of the drug trafficking statute's evidence preservation mandates.
