The High Court of Cassation and Justice, sitting as the panel for resolving questions of law, admitted the preliminary reference and interpreted the statute to grant the prefect exclusive competence to terminate the mandate of a local councilor via administrative order, in favor of the position that administrative authorities, not courts, handle mandate loss disputes. The dispute concerned the procedural jurisdiction to resolve the early termination of a local elected official's mandate following the loss of membership in the political party or minority organization whose list they joined. The decisive legal basis is the interpretation of Article 9(3)-(4) and Article 12(3) of Law No. 393/2004 on the Statute of Local Elected Officials, which establishes that upon notification by the referring political party or minority organization, the prefect is exclusively competent to record the cessation of the mandate prior to the end of the normal term.
