The High Court of Cassation and Justice rejected as inadmissible the referral for a preliminary ruling on a question of law submitted by the Court of Appeal of Craiova, leaving the referring court to proceed without a binding interpretation from the supreme judicial body. The dispute concerned the interpretation of administrative regulations regarding building permits, specifically whether the legal framework for regularizing a construction edified prior to the issuance of an authorization required exclusively the documents enumerated in Article 59(3) of the Methodological Norms for the application of Law No. 50/1991, or whether it also necessitated the additional documents prescribed by Article 7 of Law No. 50/1991. The decisive legal basis for this dismissal was the procedural rule that such referrals must meet specific admissibility criteria, which the submitted question failed to satisfy, although the underlying substantive issue remains rooted in the interpretation of the Building Law (Law No. 50/1991) and its implementing methodological norms (Order No. 839/2009).
