The High Court of Cassation and Justice confirmed the finality of the lower court judgments by declaring the defendant's appeal (recurs) perished, thereby upholding the appellate decision that had previously rejected the defendant's appeal against the first-instance judgment ordering the payment of a commercial debt and penalties. The dispute arose from a civil action for the collection of a monetary sum based on a commercial contract, which was initially granted in favor of the state-owned forestry plaintiff by the first-instance tribunal and subsequently upheld by the court of appeal. The decisive legal basis for this procedural outcome was the application of the Civil Procedure Code provisions governing the suspension of proceedings due to the absence of both parties and the subsequent lapse of the six-month time limit for resuming the case without a party request, leading to the ex officio declaration of the perishment of the appeal under Articles 248(3) and 252.

248 alin. (3) și art. 252 C. proc. civ., urmează a constata, din oficiu, perimat recursul pârâtei.
