The High Court of Cassation and Justice ordered the case to be remitted to the Gorj County Court for competent resolution, thereby dismissing the appeal for lack of material jurisdiction and leaving the lower court’s decision exonerating the defendant from a fine in force. The dispute arose from an administrative law challenge to a traffic violation report issued by the financial police, which the defendant contested, leading the first-instance court to annul the report and waive the 20,000,000 lei fine. Applying the procedural rules for judicial challenges to contraventional decisions under Law No. 180/2002 approving O.G. No. 2/2001, specifically Article 11, the Court determined that appeals against such decisions must be filed with the administrative section of the county court, not the supreme court, and thus lacked the authority to review the merits of the appeal.

Asupra recursului de față;

159 alin. (3) și ale art. 299 C. proc. civ., astfel cum a fost completat prin O.U.G. nr. 58/2003.
